General Terms and Conditions of Travel and Payment / GTC

Dear meinpep customer,

The booking of one or more travel services of meinpep / Ebel Touristik GmbH (hereinafter referred to as meinpep) is made on the basis of the following Terms and Conditions of Travel and Payment for package travel contracts and contracts for individual tourist services. This includes
- Contracts for pure accommodation and lodging services in hotels, holiday flats and holiday homes (in particular "hotel only"),
- Contracts for pure transport services such as, in particular, flight services (in particular "flight only" as a charter flight or scheduled flight) or transfer services without further travel services and
- Contracts for other individual tourist services such as, in particular, admission tickets

The following deviations apply:
The following clauses of the Terms and Conditions of Travel and Payment apply exclusively to package holidays (and not to individual tourist services):

Please pay attention to these terms and conditions, as by making a booking you recognise these terms and conditions, which will be sent to you prior to booking. They apply to all trips. They supplement the statutory provisions of §§ 651a - y BGB and Art. 250 and 252 EGBGB (Introductory Act to the German Civil Code) for package holidays and §§ 535 ff BGB and §§ 631 ff. BGB for contracts for pure accommodation or pure transport and complete these. These travel conditions do not apply to brokered individual services (e.g. cruises, hire cars and campers, holiday homes, parking, travel protection, excursions & tickets, sporting events and benefit partners) or the brokerage of associated travel services within the meaning of Section 651w BGB.

1 Conclusion of the contract

The travel registration in accordance with the invitation to tender shall become binding upon receipt by meinpep. The applicant shall also be responsible for all persons listed in the registration, insofar as he has assumed this obligation by means of an express separate declaration. The contract shall be concluded upon receipt of the travel confirmation / invoice by meinpep. Upon or immediately after conclusion of the contract, meinpep shall send the traveller a travel confirmation on a permanent data carrier in accordance with the statutory requirements when booking a package tour, unless the traveller is entitled to a travel confirmation in paper form in accordance with Art. 250 § 6 para. 1 sentence 2 EGBGB because the contract was concluded in the simultaneous physical presence of both parties or outside of business premises. Local and hotel brochures as well as internet advertisements that are not published by meinpep are not binding for meinpep and its obligation to perform, unless they are made the subject of the travel advertisement or the content of meinpep's obligation to perform by express agreement with the customer.

If the content of the confirmation deviates from the booking content, a new contractual offer shall exist, to which meinpep shall be bound for a period of 10 days. The contract shall be concluded on the basis of this new offer if meinpep has pointed out the change with regard to the new offer and has fulfilled its pre-contractual information obligations and the traveller confirms this within the binding period by express declaration of acceptance or declares the down payment.

Please note that for all of the above-mentioned booking types, there is no right of cancellation for package travel contracts and contracts for individual tourist services concluded at a distance after conclusion of the contract due to the statutory provision of Section 312 g (2) sentence 1 no. 9 BGB. Cancellation and termination of the contract, on the other hand, is possible in accordance with the provision in section 6.

In the case of third-party services (e.g. car hire, flight-only) or package holiday offers (e.g. cruises) expressly and clearly described as arranged in the brochure, travel documents and other declarations, meinpep is merely a travel agent. In this respect, meinpep shall only be liable for the brokerage, but not for the brokered services themselves (cf. Sections 675, 631 BGB). Any further liability is excluded. Excluded from the limitation of liability in accordance with this clause is liability for damages resulting from injury to life, body or health and for other damages, insofar as the latter are based at least on a grossly negligent breach of duty by meinpep or its legal representative or a vicarious agent. Liability for the breach of material contractual obligations shall also be excluded from the limitation of liability pursuant to sentence 2. The provisions of Section 1.2 and the following shall apply mutatis mutandis to the conclusion of the contract.

The provisions of clause 1 shall apply mutatis mutandis to the conclusion of the contract.

2 Special features of meinpep holidays

2.1 The services booked are based on special prices provided by the service providers exclusively for tourism professionals. You are therefore obliged to prove your identity accordingly at the request of the service provider. This is possible, for example, by means of a DRV ID card, employee ID card, business card in conjunction with an identity card or a corresponding letter of confirmation from your employer. If you are unable to prove your identity, you must reckon with a subsequent charge or exclusion from benefits. A refund of prices already paid for certain services after the trip is excluded in such a case. Please ensure that the e-mail addresses and telephone numbers you provide are correct. Both are essential for communication between you and meinpep. In their own interest, users/travellers should therefore inform meinpep of any changes to their e-mail address or telephone number as soon as possible.

2.2 As a precautionary measure, we would like to point out that the intentional, unauthorised use of our Pep offers may constitute a criminal offence under Section 263 of the German Criminal Code (StGB) and may be prosecuted accordingly. This penalty may also apply to employers who forward our offers to third parties (friends, customers, etc.) without authorisation.

2.3 meinpep and its service providers reserve the right to charge the price difference to the regular end consumer price in the event of insufficient legitimisation.

2.4 The special prices for tour operators may not be communicated to third parties. Any breach of this obligation may result in a subsequent charge, exclusion from the booked service and exclusion from the use of meinpep. This also applies to false information provided during registration. meinpep reserves the right to verify the information provided by registered users.

2.5 As a tourism professional, you are obliged to view hotels booked via meinpep and to be available for a discussion with the hotel management by prior arrangement.

2.6 meinpep is not obliged to accept every registration of a tour operator. It is exclusively up to meinpep to decide this.

3 Insolvency insurance exclusively for package holidays / general terms of payment for package holidays and individual services / cancellation in the event of late payment

3.1 meinpep has taken out insolvency insurance with Deutscher Reisesicherungsfonds GmbH to protect the customer's money. The insurance certificate shall be sent with the down payment or final payment invoice when a package holiday is booked.

3.2 Upon conclusion of the contract, a down payment of usually 20% of the total price is due upon receipt of the confirmation, unless otherwise contractually agreed.

3.3 The balance must be paid no later than 28 days before the start of the holiday.

3.4 The entire invoice amount is due immediately after receipt of the confirmation in the following cases:
- for bookings of individual tourist services with a total travel price of up to Euro 200,00
- for travel bookings made 30 days or more before departure
- for all charter and scheduled flights.

3.5 Payment can be made either by direct debit or credit card (Visa or MasterCard), depending on the period up to departure. The amounts will be automatically debited to the account or credit card on the agreed due dates.

3.6 In the case of payments from abroad, all fees incurred shall be borne by the customer making the payment.

3.7 In the event of rejection of payments and returned direct debits due to incorrect account details or insufficient funds, any bank charges incurred as a result, which are not due to meinpep's fault, shall be charged to the travel applicant at a rate of EUR 10,00 per case.

The customer shall be at liberty to prove that meinpep actually incurred no or lower costs.

3.7 If you do not pay on time despite meinpep's corresponding willingness to perform, meinpep shall be entitled to withdraw from the contract after issuing a reminder and setting a deadline and to demand reasonable compensation from you for the arrangements made up to the cancellation and its expenses depending on the respective travel price in accordance with Sections 6.1 to 6.4 of these Terms and Conditions.

4 Travel documents

The travel documents are generally sent electronically. If you have not received the travel documents at least 7 days prior to departure, please contact meinpep immediately.

5 Essential characteristics and changes to services

5.1 Deviations of essential characteristics of travel services from the agreed content of the contract which become necessary after conclusion of the contract and which were not brought about by meinpep in bad faith shall only be permitted before the start of the trip insofar as the deviations are not significant and do not impair the overall design of the booked trip. meinpep shall be obliged to inform the traveller of changes to services and deviations in services immediately after becoming aware of the reason for the change on a durable medium in a clear, comprehensible and prominent manner.

5.2 In the event of a significant change to an essential feature of a travel service or a deviation from special requirements, the traveller shall be entitled to either accept the change within a reasonable period of time or to withdraw from the travel contract free of charge or to demand participation in a replacement trip if meinpep has offered such a trip. The traveller has the choice to react to the notification or not. If the traveller does not respond to meinpep or does not respond within the statutory period, the notified change shall be deemed to have been accepted. The traveller shall be informed of this in connection with the notification of change in a clear, comprehensible and emphasised manner.

5.3 Any warranty claims shall remain unaffected if the modified services are defective. If meinpep had lower costs for the realisation of the changed trip or replacement trip with equivalent quality, the customer shall be reimbursed the difference in accordance with § 651m para. 2 BGB.

5.4 In the case of boat trips, the captain alone shall decide on any necessary changes to the journey time and/or routes, for example for safety or weather reasons.

6 Cancellation by the traveller

6.1 You can cancel the trip / booked service at any time before the start of the trip. In the event of cancellation of package tours, meinpep shall be entitled to reasonable compensation unless meinpep is responsible for the cancellation or unless extraordinary circumstances occur at the destination or in its immediate vicinity which significantly impair the performance of the tour or the transport of persons to the destination; circumstances are unavoidable and extraordinary if they are beyond meinpep's control and their consequences could not have been avoided even if all reasonable precautions had been taken. The time of commencement of the first contractual package holiday service shall be decisive for the calculation of compensation. This date shall also apply to all further services as the date of commencement of travel.

In the event of cancellation of individual tourist services, meinpep shall be entitled to reasonable compensation, unless meinpep is responsible for the cancellation. The time of commencement of each individual contractual service shall be decisive for the calculation of the compensation. In the case of several individual travel services, the cancellation fees shall be calculated individually and then added together.

Cancellation should always be made in writing (only possible Monday to Friday until 15:00, excluding public holidays).

Compensation is calculated as follows according to the time of receipt of the cancellation notice:

The following applies to all hotel and package holiday bookings:
- up to the 31st day before departure 25% min. Euro 50,00 per booking
- from the 30th day before departure 40% min. Euro 50,00 per booking
- from the 25th day before departure 50% min. Euro 50,00 per booking
- from the 15th day before departure 80% min. Euro 50,00 per booking
- from the 8th day before departure 90% min. Euro 50,00 per booking
- from the 2nd day before departure until the day of departure or in the event of non-commencement of the trip or early departure 95% of the travel price at least Euro 50,00 per booking

Due to the administrative costs associated with the cancellation of a booking, a processing fee of Euro 50,00 per cancelled order will be charged. This processing fee is non-refundable.

For all ROBINSON and Aldiana bookings, the following special cancellation scale applies:
- up to 31 days before departure 40%, min. 50,00 Euro
- from the 30th day before departure 55%, min. 50,00 Euro
- from the 24th day before departure 65%, min. 50,00 Euro
- from the 17th day before departure 80%, min. 50,00 Euro
- from the 10th day before departure 85%, min. 50,00 Euro
- from the 3rd day before departure 90%, min. 50,00 Euro
- from the 2nd day before departure until the day of departure or in the event of non-commencement of the holiday 95% of the holiday price, min. 50,00 Euro

The following applies to all ROBINSON Clubs:
- all further rebookings or changes to an existing booking are only possible by cancellation (see cancellation scale) and an associated new booking
- rebooking to another club is possible against cancellation (see cancellation policy) and rebooking

For all MAGIC LIFE bookings, the separate cancellation scale below applies:
- up to 31 days before departure 40%, min. 50,00 Euro
- from the 30th day to the 15th day before departure 60%, min. 50,00 Euro
- from the 14th day to the 4th day before departure 85%, min. 50,00 Euro
- from the 3rd day to the 1st day before departure 90%, min. 50,00 Euro
- on the day of departure or in the event of non-commencement of the trip 95% of the travel price, min. 50,00 Euro

The following special cancellation conditions apply to Muthu Hotels:
Summer 2024:
- Grand Muthu Golf Plaza Hotel (Summer 2024/Winter 2024/2025: 3 nights will be charged for cancellations within 10 days prior to arrival, 95% for stays of less than 3 nights, no show or early departure 95% of the total price, min. 50,00 Euro
- Muthu Clube Praie da Oura, Grand Muthu Forte da Oura, Grand Muthu Forte do Vale, Grand Muthu Oura View Beach Club, Muthu Oura Praia Hotel and MGM Muthu Raga Madeira Hotel: for cancellations within 20-15 days prior to arrival 50% of the total booking will be charged, for cancellations within 14-10 days prior to arrival 75% of the total booking will be charged, for cancellations within 9 days as well as no show or early departure 95% of the total price, min. 50,00 Euro

The following special cancellation conditions apply for the Dukley Hotel & Resort, Infinity by Dukley and Hotel Harmonia by Dukley:
- July and August: 10 days before arrival until the day of departure: 95% cancellation fee, min. 50,00 Euro

For the Mövenpick Resort & Spa Jimbaran the following special cancellation conditions apply:
- 95% cancellation fee from 7 days before arrival until the day of arrival or no-show: 07.01. - 14.07.2024 and 01.09. - 31.10.2024, min. 50,00 Euro
- 95% cancellation fee from 14 days before arrival until the day of arrival or no-show: 15.07. - 31.08.2024, min. 50,00 Euro

For the hotels Alam Anda Ocean Front Resort & Spa, Huni Lio and Seda Lio the following special cancellation conditions apply:
- from 7 days or less / no-show / early departure 95% of the total amount, min. 50,00 Euro

The following special cancellation conditions apply to the Hotel Pilgrimage Village Boutique Resort & Spa:
- from the day of booking, in case of early departure or no-show 95% of the total price, min. 50,00 Euro

The following special cancellation conditions apply for the Hotel Vedana Lagoon Resort & Spa:
- from the 30th day to the 16th day before departure 50% of the total price, min. 50,00 Euro
- from the 15th day or later, no show or early departure 95% of the total price, min. 50,00 Euro

The following special cancellation conditions apply for the Hotel Bliss Hoi An Beach Resort & Wellness:
- from the 21st day to the 11th day before departure 70% of the total price, min. 50,00 Euro
- from the 10th day or later, no show or early departure 95% of the total price, min. 50,00 Euro
- from the 30th day or later, no show or early departure 95% of the total price (27.04. - 02.05.2024 and 01.09. - 03.09.2024), min. 50,00 Euro

The following special cancellation conditions apply for the Hotel Ktima Mani:
- from the 4th day before departure until the day of departure or no show 95% of the travel price, min. 50,00 Euro

The following special cancellation conditions apply to the Athens Key Hotel:
- in high season: from the 4th day before departure until the day of departure, no show or early departure 95% of the total price, min. 50,00 Euro

The following special cancellation conditions apply to the Arctic Earth Christmas and Arctic Earth New Year PEP Package:
- up to 46 days before departure 20% of the tour price, min. 50,00 Euro
- from the 45th to 30th day before departure 30% of the tour price, min. 50,00 Euro
- from the 29th to 15th day before departure 40% of the tour price, min. 50,00 Euro
- from the 14th to the 7th day before departure 60 % of the tour price, min. 50,00 Euro
- from the 6th day before departure 80% of the tour price, min. 50,00 Euro
- from 1 day before departure or no-show 90 % of the tour price, min. 50,00 Euro

The following special cancellation conditions apply to Lion Roars Hotels:
Singa Lodge, Cottage Pie by Robberg Beach Lodge, The Robberg Beach Lodge, Plett Quarter Hotel, Franschhoek Boutique Hotel, The Three Boutique Hotel, Kloof Street Hotel, Old Bank Hotel:
- from the 29th to the 15th day before departure 50% of the tour price, min. 50,00 Euro
- from the 14th to 1 day before the start of the trip 80% of the price of the trip, min. 50,00 Euro
- No Show 95 % of the tour price, min. 50,00 Euro
Bukela Game Lodge, Hlosi Game Lodge:
- from the 29th to 15th day before departure 25% of the tour price, min. 50,00 Euro
- from the 14th to the 3rd day before departure 50 % of the tour price, min. 50,00 Euro
- from 48 hours before departure 80 % of the tour price, min. 50,00 Euro

The following special cancellation conditions apply for the Alexandros Palace:
- from the 7th to 1 day before arrival 30 % of the travel price: 26.04.-16.05.2024, 10.10.-24.10.2024, 17.05.-30.05.2024, 26.09.-09.10.2024, min. 50,00 Euro
- from the 14th to 1 day before arrival 30 % of the travel price: 31 May - 27 June 2024, 11 September - 25 September 2024, 28 June - 21 July 2024, 23 August - 10 September 2024, 22 July - 22 August 2024, min. 50,00 Euro
- No show or early departure 95 % of the holiday price in all seasons, min. 50,00 Euro

The following special cancellation conditions apply to the Victory Gästehaus Therme Erding:
- -up to 24 hours before arrival free of charge, thereafter and in case of no show 95% of the travel price, min. 50,00 Euro

For the hotels SBH Kilindini and SBH Monica Zanzibar the following cancellation conditions apply:
- from the 7th day before departure until the day of departure or in the event of no show 95% of the tour price, min. 50,00 Euro

For Djerba Golf Resort & Spa, Hari Club Beach Resort, PrimaSol El Mehdi, Helya Beach Resort and El Ksar Resort & Thalasso the following special cancellation conditions apply:
- from the 3rd day before departure until the day of departure or in case of no-show or early departure 95% of the travel price, min. 50,00 Euro

The following special cancellation conditions apply to the Hotel NOOE Maldives Kunaavashi:
- Free cancellation up to 7 days before the original arrival date, min. 50,00 Euro
- for cancellations between 7 and 0 days 95% of the total stay will be charged, min. 50,00 Euro
- in case of no-show 95% of the total stay will be charged, min. 50,00 Euro

The following special cancellation conditions apply for Le Méridien Maldives Resort & Spa:
- from the 30th day before departure until the day of departure or in case of no-show or early departure 95% of the total stay, min. 50,00 Euro

The following separate cancellation conditions apply to the Cape Fahn Hotel:
Cancellation must be made in writing 72 hours before the arrival date. Otherwise, the hotel reserves the right to charge the first night of the stay, except in the following periods:
- 01/06/2024 - 08/31/2024, a minimum notice period of 14 days is required, otherwise the cancellation fee corresponds to the fee for the entire booking, at least 50.00 Euro
- December 23, 2024 - January 5, 2025, a minimum notice period of 30 days is required, otherwise the cancellation fee corresponds to the fee for the entire booking, at least 50.00 Euro
- January 6th, 2025 - August 31st, 2025, a minimum notice period of 14 days is required, otherwise the cancellation fee corresponds to the fee for the entire booking, at least 50.00 Euro
- No show is subject to a fee equal to the minimum price for one night, with the exception of the period December 23, 2023 - August 31, 2024 and December 23, 2024 - August 31, 2025, in which a fee equal to the total stay is charged, at least 50.00 Euro
- In the event of early departure, a fee equal to the minimum price for one night will be charged, except in the period from December 23rd, 2023 - August 31st, 2024 and December 23rd, 2024 - August 31st, 2025, when the fee corresponds to the total stay, at least 50.00 Euro

The following separate cancellation policy applies to Cape Panwa Hotel:
Cancellation must be made in writing 72 hours before the arrival date. Otherwise, the hotel reserves the right to charge the first night of the stay, except in the following periods:
- December 28th, 2024 - January 7th, 2025, a minimum notice period of 30 days is required, otherwise the cancellation fee corresponds to the fee for the entire booking, at least 50.00 Euro
- January 8th, 2025 - April 15th, 2025, a minimum notice period of 14 days is required, otherwise the cancellation fee corresponds to the fee for the first night of the stay, at least 50.00 Euro
- In the event of a no-show, a fee equal to the minimum price for one night will be charged, with the exception of the period December 28, 2024 - January 7, 2025, in which a fee equal to the total stay will be charged. 50.00 Euro
- In case of early departure, a fee equal to the minimum price for one night will be charged, except in the period from December 28th, 2024 - January 7th, 2025, when the fee corresponds to the total stay. 50.00 Euro

For Kantary Beach - Khao Lak the following special cancellation conditions apply:
- Cancellation must be made in writing 72 hours prior to the arrival date, otherwise the hotel reserves the right to charge the first night of the stay

Cape Kudu Hotel has the following special cancellation policy:
- Cancellation must be made in writing 72 hours prior to the date of arrival, otherwise the hotel reserves the right to charge the first night of the stay, except during the following periods:
· 08 Jan 2024 - 30 Apr 2024, a minimum notice period of 14 days is required, otherwise the cancellation fee will be equal to the price of the first night's stay, minimum 50,00 Euro.

The following special cancellation conditions apply to the Hotel Fleur de Lys:
- from the 3rd day before departure until the day of departure or in the event of non-commencement of the trip or early departure 95% of the travel price, min. 50,00 Euro.

The following special cancellation conditions apply to Fiyavalhu Resort Maldives:
- from the 3rd day before the start of the trip until the day of departure or in the event of non-commencement of the trip or early departure 95% of the trip price, min. 50,00 Euro

The following special cancellation conditions apply for Fushifaru Maldives:
- from the 7th day before the start of the trip until the day of departure or in the event of non-commencement of the trip or early departure 95% of the trip price, min. 50,00 Euro

The following special cancellation conditions apply for Cortijo El Sarmiento:
- from the day of booking 50%, up to 14 days before departure or in case of no-show 95% of the total price, min. 50,00 Euro

For all Palladium bookings, the following special cancellation scale applies:
- 89 to 45 days before departure 30% min. 50,00 Euro
- 44 to 30 days before departure 50% min. 50,00 Euro
- 29 to 3 days before departure 75% min. 50,00 Euro
- 72 hours or less before departure 95% min. 50,00 Euro

The following special cancellation conditions apply to Parklane a Luxury Collection Resort & Spa Limassol:
- from one day before departure or later and no show 95% of the travel price, min. 50,00 Euro
- Separate regulation from 21.07.-28.08.2024 from 7 days before departure or thereafter and no show 95% of the travel price, min. 50,00 Euro

The following special cancellation conditions apply for the Park Hyatt Maldives Hadahaa:
- 50% cancellation fee from 30 days before arrival and 95% cancellation fee from 14 days before arrival until the day of arrival or no-show: 08.02. - 08.05.2024, min. 50,00 Euro
- 95% cancellation costs from 5 days before arrival until the day of arrival or no-show: 09.05. - 30.09.2024, min. 50,00 Euro
- 95% cancellation fee from 7 days before arrival until the day of arrival or no-show: 01.10. - 20.12.2024, min. 50,00 Euro
- The following special cancellation conditions apply to Adaaran Resorts & Hotels:
- 95% cancellation fee from 5 days before arrival until the day of arrival or no-show: 01.05. - 30.09.2024, 01.11. - 25.12.2024 and 01.05. - 30.09.2025, min. 50,00 Euro
- 95% cancellation costs from 21 days before arrival until the day of arrival or no-show: 26.12.2024 - 10.01.2025, min. 50,00 Euro
- 95% cancellation costs from 14 days before the start of the trip until the day of arrival or no-show: 11.01. - 30.04.2024 and 11.01. - 30.04.2025, min. 50,00 Euro
- 95% cancellation fee from 10 days before departure until the day of arrival or no-show: 01.10. - 31.10.2024 and 01.10. - 31.10.2025, min. 50,00 Euro

For the Sea Resorts (Seapoint Boutique Hotel, Seasense Boutique Hotel & Spa, Sea Diamond Boutique Hotel & Spa, Chalets Chamarel and Ocean V), the following special cancellations conditions apply:
- 95% cancellation fee from 7 days before arrival until the day of arrival or no-show: 01.05.2024 - 21.12.2024 and 05.01.2025 - 31.10.2025, min. 50,00 Euro
- 95% cancellation fee from 45 days before arrival until the day of arrival or no-show: 22.12.2024 - 04.01.2025, min. 50,00 Euro

The following special cancellation conditions apply for the Hotel Dusit Thani Maldives:
- from the 30th day to the 21st day before departure 50% of the travel price, min. 50.00 Euro
- from the 20th day before departure until the day of departure or in case of no-show or early departure 95% of the tour price, min. 50,00 Euro
- 11.04. - 23.12.2024 and 08.05.2025 - 19.12.2025: from the 14th day before the start of the trip until the day of the start of the trip or in the event of non-commencement of the trip or early departure 95% of the trip price, min. 50.00 Euro

The following special cancellation conditions apply to Naturel Hotels & Resorts:
From winter 2024/25 (20.12.2024)
- from the 14th to the 8th day before departure 50% of the travel price, min. 50,00 Euro
- from the 7th day before departure 90 % of the tour price, min. 50.00 Euro

The following special cancellation conditions apply to Bay Resort Hoi An:
- from the 14th day before departure until the day of departure or in case of no-show or early departure 95% of the tour price, min. 50,00 Euro

The following special cancellation conditions apply to Dallago Tours round trips:
- from the 30th to 15th day before departure 50% of the tour price, min. 50,00 Euro
- from the 14th day before departure or after, as well as no show and no-show 95% of the tour price, min. 50,00 Euro

6.2 Cancellation conditions for package tours:
- up to the 31st day before departure 60% min. Euro 50,00 per booking
- from the 30th day before departure 70% min. Euro 50,00 per booking
- from the 14th day before departure 90% min. Euro 50,00 per booking
- from the 2nd day before departure until the day of departure or in the event of no-show 95% of the tour price min. Euro 50,00 per booking

6.3 Flights

After a firm booking has been made, the price of air transportation included in the carriage charge will not be refunded when flights are cancelled, only the taxes and fees. Due to the administrative costs associated with a cancellation, a processing fee of EUR 50.00 per canceled flight and per person will be charged. This handling fee is non-refundable. Any payments received from you up to this amount will be retained or you may be obliged to pay the difference up to this amount. In the above cases, the customer is at liberty to prove that meinpep has suffered no loss or a lesser loss than that claimed with the handling fee.

Entitlement to compensation for PEP flights - there is no entitlement to compensation for PEP or discounted flights. Also, the Regulation - Regulation (EC) No 261/2004 of the European Parliament and of the Council of February 11, 2004 - Air Passenger Rights Regulation does not apply to passengers traveling free of charge or at a reduced fare that is not directly or indirectly available to the public.

6.4 Costs for any visa arrangements or travel insurance as well as processing fees shall always be borne 100% by you, even in the event of cancellation.

6.5 The above-mentioned provisions regarding cancellation costs apply to all trips/offers, unless separate regulations are indicated in the respective advertisement. In any case, you shall be at liberty to provide evidence that meinpep has incurred no or significantly lower costs as a result of the cancellation.

6.6 meinpep reserves the right to demand higher, individually calculated compensation instead of the above lump sums, insofar as meinpep proves that it has incurred significantly higher expenses than the applicable lump sum. In this case, meinpep shall be obliged to specifically quantify and justify the compensation claimed, taking into account the expenses saved and less what it acquires through other use of the travel service.

7 Rebooking by the traveler

7.1 The traveler is not entitled to make changes to the travel date, the travel destination, the place of departure, the accommodation or the mode of transport (rebooking) after conclusion of the contract.

7.2 If, at the request of the traveler, changes are made to the date of travel, types of board, room categories, type of transport, additional persons or dates up to 31 days before departure, meinpep shall be entitled to charge a processing fee of EUR 25,00 per person. If such a rebooking results in higher travel prices for the traveler and/or fellow travelers, the price difference shall be paid by the travel participant.

For Aldiana bookings, the special rebooking scale below applies:
- up to 31 days before departure 40%, min. 50,00 Euro
- from the 30th day before departure 55%, min. 50,00 Euro
- from the 24th day before departure 65%, min. 50,00 Euro
- from the 17th day before departure 75%, min. 50,00 Euro
- from the 10th day before departure 85%, min. 50,00 Euro

7.3 Rebookings/changes after the deadline of 30 days before departure for trips involving the purchase of admission tickets (e.g. musicals) and for flight tickets are not possible. Instead, you can withdraw from the booked trip under the conditions stated in these terms and conditions and make a new booking in accordance with your wishes. Similarly, changes to the destination can only be made after withdrawal from the travel contract under the conditions set out in section 6.1 or 6.2 and simultaneous re-registration. The travel applicant is responsible for coordinating their change requests with any other travel services they have booked.

7.4 The applicant may nominate substitute persons for himself and/or fellow travelers. As the programs are special trips for tourism professionals, both the applicant and any substitute person for the applicant must always belong to this group. If a third party takes the place of the registered participant, meinpep shall be entitled to charge a lump sum of EUR 50,00 to service providers (e.g. airlines) for the processing costs incurred as a result of the participation of the substitute person, in addition to any additional costs incurred as a result. You are at liberty to prove that no or significantly lower costs were incurred with the entry of the third party.

8 Services not used

If the traveler does not make use of individual travel services that were duly offered to him for reasons attributable to him (e.g. due to early return or other compelling reasons), he shall not be entitled to a pro rata refund of the travel price. meinpep shall endeavor to obtain reimbursement of the expenses saved by the service providers. This obligation shall not apply in the case of completely insignificant services or if statutory or official regulations prevent reimbursement and the equivalent value of the service is less than EUR 50.00. meinpep reserves the right to charge a processing fee.

9 Withdrawal/rebooking on the part of meinpep

9.1 meinpep may withdraw from the travel contract up to 20 days before the start of the trip if the advertised or officially specified number of participants is not reached, if the travel advertisement and the travel confirmation refer to the fact that the trip will only be carried out if a certain number of participants is reached. The travel price already paid shall then be refunded immediately, but in any case within 14 days of receipt of the declaration of withdrawal.

9.2 meinpep may withdraw from the contract before the start of the tour if it is prevented from fulfilling the contract due to unavoidable, extraordinary circumstances; in this case, it must declare its withdrawal immediately after becoming aware of the reason for withdrawal. If meinpep withdraws from the contract, meinpep shall lose its claim to the agreed travel price.

10 Termination for reasons of conduct

meinpep may terminate the travel contract without notice if the traveler persistently disrupts the contract despite a warning from meinpep or if the traveler behaves contrary to the contract to such an extent that the immediate termination of the contract is justified.

11 Passport, visa, health and entry requirements for package tours

11.1 When booking a package tour, meinpep shall inform the customer / traveler about general passport and visa requirements as well as health formalities of the country of destination, including the approximate deadlines for obtaining the necessary visas, prior to the conclusion of the contract and, if necessary, about any changes up to the start of the trip.

11.2 The traveler is responsible for complying with all regulations relevant to the execution of the trip. All disadvantages, in particular the payment of cancellation costs arising from non-compliance with these regulations, shall be borne by the traveler, unless they are caused by culpable misinformation or non-information on the part of meinpep.

11.3 meinpep shall not be liable for the timely issuance and receipt of necessary visas by the respective diplomatic representation if you have commissioned meinpep to obtain them, unless meinpep is responsible for the delay. You should allow approximately 8 weeks for obtaining visas etc. from the relevant authorities.

11.4 Please refer to the pre-contractual information as to whether a passport is required for your trip or whether an identity card is sufficient, and please ensure that your passport or identity card is valid for a sufficient period of time for the trip. Children require their own travel documents.

11.5 Customs and foreign exchange regulations are very strict in various countries. Please inform yourself carefully and be sure to follow the regulations.

11.6 Various countries require certain vaccination certificates, which must not be less than 8 days old and not older than 3 years (smallpox) or 10 years (yellow fever). Such vaccination certificates must also be presented to the German authorities if you are returning from certain countries (e.g. Africa, Middle East). Please refer to the pre-contractual information for the relevant information.

12 Limitation of liability

12.1 meinpep's contractual liability for damages that are not physical injury and were not culpably caused shall be limited to three times the travel price. Any claims in excess thereof under international agreements or statutory provisions based on such agreements shall remain unaffected by this limitation.

12.2 meinpep shall not be liable for service disruptions, personal injury and property damage in connection with services that are merely arranged as third-party services (e.g. excursions, sporting events, theater visits, exhibitions, transportation services from and to the advertised point of departure and destination) if these services are expressly and clearly identified as third-party services in the travel description and the booking confirmation, stating the arranged contractual partner, so that they are recognizably not part of meinpep's travel services for the traveler. meinpep shall, however, be liable

a) for services that include the transportation of the traveler from the advertised point of departure to the advertised destination, intermediate transportation during the trip and accommodation during the trip,

b) if and to the extent that the damage suffered by the traveller is caused by a breach of meinpep's obligations to provide information, clarification or organization.

13 Duty of the traveler to cooperate

13.1 If a travel service is not provided or is not provided free of travel defects, the traveler may demand redress. meinpep may refuse redress if it is impossible or involves disproportionate costs.

13.2 The traveler may demand a reduction of the travel price if travel services have not been provided free of travel defects and the traveler has not culpably failed to report the defect immediately (without culpable delay). The travel participant is obliged to notify either the hotel on site or meinpep itself immediately of any defects occurring at the start of or during the trip in order to give meinpep the opportunity to remedy the situation. Termination for good cause due to unreasonableness of the continuation of the trip remains unaffected by this.

13.3 If meinpep is unable to remedy the situation as a result of a culpable failure to report a defect, the traveler may neither assert claims for a reduction in price pursuant to § 651m nor claims for damages pursuant to § 651n.

13.4 If a customer/traveler wishes to terminate the travel contract due to a significant travel defect of the type specified in § 651 i BGB in accordance with § 651 l BGB or for good cause recognizable by meinpep due to unreasonableness, he must first set meinpep a reasonable deadline for remedial action. This shall only not apply if remedial action is impossible or is refused by meinpep or if the immediate termination of the contract is justified by a special interest of the customer/traveler recognizable by meinpep.

13.5 In the case of package tours, meinpep refers to the duty to provide assistance in accordance with Section 651 q BGB, according to which, in the case of Section 651 k (4) BGB or for other reasons of difficulty, assistance must be provided to the traveler without delay in an appropriate manner, in particular by providing suitable information on health services, local authorities and consular assistance, assistance in establishing long-distance communication links and assistance in finding other travel options. Section 651 k (3) BGB remains unaffected.

14 Exclusion of claims, limitation period

14.1 The traveler must assert contractual claims against meinpep. It is recommended that claims be asserted on a durable medium. Contractual claims shall become time-barred after two years in accordance with § 651 j BGB. The limitation period shall commence on the day on which the trip should end according to the contract. Otherwise, the statutory provisions shall apply.

14.2 meinpep strongly recommends that damage or delays in delivery during air travel be reported immediately on the spot to the responsible airline by means of a damage report (P.I.R.). As a rule, airlines refuse refunds if the damage report has not been completed. The damage report must be submitted within 7 days in the case of damaged baggage and within 21 days of delivery in the case of delayed baggage. Otherwise, the loss, damage or misdirection of baggage must be reported to the tour guide or meinpep.

15 Identity of the operating air carrier

If the travel contract includes carriage by air, the traveler will be informed at the time of booking of the identity and name of the operating air carrier of all air transport services to be provided as part of the booked trip. If the identity of the air carrier has not yet been determined at the time of booking the trip, the traveler will be informed of the airline or airlines that are likely to operate the flight or flights and the traveler will be informed immediately as soon as this has been finally determined. If the airline notified to the traveler changes, meinpep must inform the traveler of the change without delay. The organizer must take all reasonable steps to ensure that the traveler is informed of the change as soon as possible. 16 Consumer dispute resolution/OS platform

The European Commission provides a platform for the online settlement of consumer disputes at http://ec.europa.eu/consumers/odr/. meinpep participates in this voluntary procedure for alternative dispute resolution.

17 Travel insurance

Unless expressly stated otherwise, travel insurance is not included in the travel prices. We recommend that you take out travel cancellation, travel liability, health and accident insurance. The premiums for insurance are not part of the tour price and are due for payment immediately upon taking out the insurance. It is also not possible to withdraw from insurance contracts.

18 Data protection

18.1 Registration with meinpep and the use of our travel offers requires the electronic storage of your data. This data will be used by meinpep exclusively for contract processing.

18.2 The personal data that you provide to us will be processed electronically and used to the extent necessary for the performance of the contract. All your personal data will be processed in accordance with German and European data protection law. Further information on the handling of your data can be found in our

privacy policy at: www.meinpep.de/Datenschutz.

19 Other provisions and agreements

Should any provision of this contract be or become invalid, this shall not affect the validity of all other provisions. The parties shall agree a new, valid provision that comes as close as possible to the intent and purpose of the original provision.
